For many, it is their first brush with the law, and, without knowing how the system works, can be confusing and highly stressful. You may think that with chemical testing results, such as breathalyzer or blood tests, you have little to no chance of escaping the harsh consequences of these charges. However, you would be wrong. Many DUIs are based on faulty evidence stemming from substandard police procedures, defective or poorly maintained testing equipment, and other errors which can negate the charges.

Types Of Criminal Defense Cases We Win

DUI/DUID in Colorado

Driving under the influence in Colorado law means a driver is not able to safely operate a vehicle with “clear judgment, sufficient physical control, or due care.” 

Colorado breaks this down into the following:

  • Driving with a blood alcohol concentration (BAC) of .08 percent or higher (DUI per se)
  • Driving while under the influence of alcohol, drugs, or both (DUI)
  • Driving while ability impaired (DWAI) by alcohol, drugs, or both 

DWAI means that the driver’s abilities have been impaired even to a slight degree. 

Penalties 

A first-offense DUI is charged as a misdemeanor carrying the following penalties:

  • Five days up to one year of jail time unless your BAC measured .20 percent or higher which carries a minimum of 10 days of mandatory jail time
  • Fines ranging between $600 to $1,000
  • 48 to 96 hours of community service
  • A license suspension of 9 months
  • 12 demerit points added to your driving record
  • Potential alcohol education program
  • Probation for up to two years

A first-offense DWAI is charged as a misdemeanor carrying the following penalties:

  • Two up to 180 days of jail time expanded to a minimum of 10 days if your BAC measured .20 percent or higher
  • Fines of $200 up to $500
  • 24 to 48 hours of community service
  • 8 demerit points on your driving record
  • Probation of up to two years

Penalties will increase with each subsequent DUI or DWAI conviction. For example, license suspensions can increase to two years for a third or subsequent convictions. Jail time, fines, and community service hours will also be increased. 

After being convicted, drivers may be eligible for restricted licenses if they install and maintain an ignition interlock device in their vehicle. 

You will automatically lose your license after a DUI arrest unless you request a DMV hearing within seven days after being arrested.
